About Client Rights
The Northern Virginia Training Center assures and affirms client rights that are protected by the Constitution, Federal and State laws.
Article 3, Rights of Patients and Residents, of the Rules and Regulations To Assure the Rights of Individuals Receiving Services From Providers of Mental Health, Mental Retardation and Substance Abuse Service, states:
- Each person who is a patient, resident, or consumer in a hospital, other facility, or program operated, funded, or licensed by the Department of Mental Health, Mental Retardation and Substance Abuse Services, excluding those operated by the Department of Corrections, shall be assured his legal rights and care consistent with basic human dignity insofar as it is within the reasonable capabilities and limitations of the Department, funded program, or licensee and is consistent with sound therapeutic treatment.
1) Protection from harm;
2) Protection to exercise his legal, civil, and human rights related to the receipt of those services;
3) Respect for basic human dignity; and
4) Services that are provided consistent with sound therapeutic practice.
Providers shall not deny any person his legal rights, privileges or benefits solely because he has been voluntarily or involuntarily admitted, certified or committed to services.
Clients are given notice and assistance with their rights by Resident Advocate. When monitoring clients’ rights, the Resident Advocate acts as a mediator between clients, staff, relatives and the administration. NVTC’s Resident Advocate can be reached by calling 703-323-4015. LHRC
The Local Human Rights Committee (LHRC) is a committee of community volunteers who are broadly representative of mental health, mental retardation, and substance abuse services professionals and consumer groups, and whose responsibility is to perform certain functions specified in the "Blue Book".
Each facility operated by the Department of Mental Health, Mental Retardation, and Substance Abuse Services (DMHMRSAS) is required to establish its own LHRC.
The LHRC at the Northern Virginia Training Center has eleven members who have been appointed by the State Human Rights Committee. The LHRC plays a vital role in the DMHMRSAS Human Rights Program. The LHRC assists in the resolution of client rights complaints in that complaints which are not able to be resolved with the program can be brought to the attention of LHRC for an impartial administrative resolution.
The LHRC also plays an important role in reviewing and making recommendations concerning modification of them, conducts investigations, and reviews treatment plans particularly in the area of restrictive programming.
The LHRC carries out their duties with a large degree of autonomy and independence from the program staff.
